The Additional Sessions court in Surat has rejected Rahul Gandhi's plea to stay his conviction in the criminal defamation case, popularly called the "Modi surname" case. Rahul had approached the district court against the Surat metropolitan magistrate's order convicting him for criminal defamation for asking why all thieves had Modi as their surname in a campaign rally in Karnataka. He was sentenced to two years in jail. Consequently, as per the law, his Lok Sabha membership was terminated and he had to vacate the house allotted to him as an MP.

Rahul took the plea that the metropolitan magistrate had treated him harshly in the case but Additional Sessions Judge R P Mogera was not convinced. erefused to grant a stay on the conviction. Hence, Rahul Gandhi's Lok Sabha membership remains terminated. He will now have to approach the Gujarat HC for relief.
